Privacy Policy

1. Introduction

This Privacy Policy governs how Not 9 to 5 Organization, by way of not9to5.org and cnecting.podia.com, (collectively, the “Site”, “we”, “us”, “our”) collects uses, discloses, and protects the personal information (“Personal Information”), including the personal health information, of our customers and website users (“you”, “Users”) when you visit or make a purchase from our Site.

This policy applies to information we collect, use, or disclose about you on this Site, in email, and through all other services provided by Not 9 to 5 Organization, as described on the Site (collectively, the “Platform”).  By accessing this Site, you indicate that you understand, accept, and consent to the practices described in this Privacy Policy.

If you do not agree with the terms and conditions of this Privacy Policy, you must immediately cease using and accessing the Site and Platform, and any content, services, or products contained in or available from the Site or Platform for which you need to provide personal information.

For information on the general terms and conditions that apply to individuals (the “Terms of Use”) using the Platform (as defined herein), please see our Terms of Use.  The terms of this Privacy Policy are incorporated into, and considered part of, the Terms of Use.  In the event any additional or specific terms are inconsistent with the terms contained in this Privacy Policy, such as the Terms of Use, the Terms of Use shall prevail.

2. Information Collected

Not 9 to 5 Organization provides Users with on-demand access to mental health courses, as well as support information and resources.  For the purposes of providing these services, Not 9 to 5 Organization may need to collect information.  When you use our Site or Platform, we may collect certain information from and about you, including:

• Personal Information, that we can reasonably use to directly or indirectly identify you, such as your name, email address, Internet protocol (IP) address used to connect your computer to the Internet, user name, or other similar identifier, cookie information, account information, and any other identifier we may use to contact you online or offline.
• Non-Personal Information, that does not directly or indirectly reveal your identity or directly relate to an identified individual, such as demographic information, or statistical or aggregated information. Statistical or aggregated data does not directly identify a specific person, but we may derive non-personal, statistical, or aggregated data from Personal Information.  For example, we may aggregate Personal Information to calculate the percentage of Users accessing a specific Site feature.
• Technical Information, including your login information, browser type and version, time zone setting, browser plug-in types and versions, operating system and platform, or information about your Internet connection, the equipment you use to access our Site, and usage details.
• Non-Personal Details About Your Site Interactions, including the full Uniform Resource Locators (URLs), clickstream to, through, or from our website (including date and time), products that you viewed or searched for, page response times, download errors, length of visits to certain pages, page interaction information (such as scrolling, clicks, and mouse-overs), methods used to browse away from the page.

We may collect this information from you directly or automatically when you access and navigate through our Site.  Information collected automatically may include usage details, IP addresses, information collected through cookies, and other tracking technologies.

Please note that we do not collect any information related to payment and billing.  Our payment processing is provided by a third-party service provider, and as such, the collection, use, and disclosure of your Personal Information is governed in accordance with their own privacy policies, and not this Privacy Policy.

3. User Submissions & Social Media

Please note that when you post information to social networking sites, outside of our own Site or Platform, (e.g., re-posting a link or image from Not 9 to 5 Organization’s Instagram, Facebook, or Twitter pages, or “liking” a post from your Instagram, Facebook, or Twitter account), the Personal Information that you post or share in connection with these third-party sites is visible to other persons and can be read, collected, used and disclosed by other persons.  Any information provided to such third-party social networking sites and other sites is outside of our control and is not governed by this Privacy Policy.

4. Information Use

When you visit our Site, we collect certain information about you, your device, your interaction with the Site, and information necessary to process your purchases, in order to present our Site to you and provide you with courses, course content, products, services, and information that you request from us.  Please note that neither Not 9 to 5 Organization nor its support staff (“Support Staff”) collect or use personal information for any other purpose than providing and facilitating the provision of services on our Site and Platform.  We will, however, use information about you, including Personal Information, for the following purposes:

1. Account Registration

You do not have to register an account to use our website.  However, in order to access the courses on our Platform, you will need to register a user account (“User Account”). We collect your name, email address, and password when you register an account on our Site; you may also choose to provide a picture of yourself, and agree to receive in-app and email notifications.  We collect this information to fulfill your order, provide you with access to course content, process your payment information, provide you with invoices, and communicate with you.

Please note that persons under fifteen (15) years old are not allowed to register a User Account with our Site or Platform.  Refer to the section on “Minors” for more details.

1. Email

By providing your email address to us, you expressly consent to receive emails from us; however, you may unsubscribe from this service at any time. By providing your email address to us, you understand that we will store that email address as Personal Information for future correspondence.  We will use your email address to communicate with you, to send information that you have requested, or to send information about other products or services developed or offered by Not 9 to 5 Organization.  If you wish to unsubscribe from our email mailing list, we will delete your email address from our email database and mailing list as soon as is practicable.

You are aware that email is not a secure form of communication, and thus the distribution of any Personal Information via email is subject to risk.

1. Customer Support

When you contact us with a comment, question, or complaint, you may be asked for information that identifies you (such as your name, address, email address, or telephone number) along with additional information we need to help us promptly answer your question or respond to your comment.  We may retain this information to assist you in the future and to improve our customer support and service offerings.

1. Cookies

As you navigate through and interact with our Site, we may use cookies or other automatic data collection technologies to collect certain information about your equipment, browsing actions, and patterns.  A cookie is a small file that is downloaded to your computer or device when you visit our Site.  Cookies optimize your browsing experience on our Site by remembering your actions and preferences.

If you have an account and you log in to our Site, we will set up a temporary cookie to determine if your browser accepts cookies.  This cookie contains no personal data and is discarded when you close your browser.

When you log in, we will also set up several cookies to save your login information and your screen display choices.  Login cookies last for two days, and screen options cookies last for a year. If you select “Remember Me”, you login will persist for two weeks.  If you log out of your account, the login cookies will be removed.

You may refuse to accept browser cookies by activating the appropriate setting on your browser.  However, if you select this setting, your user experience may be negatively impacted, or you may be unable to access certain parts of the Site.

5. Links and Embedded Content

This Site may include links to, and embedded, content (e.g., videos, images, articles, etc.) from third-party websites. Embedded content from third-party websites behaves in the same way as if the visitor has visited the third-party website.

If you follow a link to a third-party website, or engage a third-party plugin, please note that these third parties have their own privacy policies and we do not accept any responsibility or liability for these policies. These third-party websites may collect data about you, use cookies, embed additional third-party tracking, and monitor your interaction with that embedded content, including tracing your interaction with the embedded content if you have an account and are logged in to that website. We do not control these third-party websites, and we encourage you to read the privacy policy of every website you visit.

6. Minors

Persons under fifteen (15) years old: we do not knowingly or intentionally allow persons under the age of 15 to create their own User Account to access our services.  Individuals under 15 years old may access the Site or Platform by using their parent or legal guardian’s User Account, and in the presence of that parent or legal guardian.  If we discover that we have collected the Personal Information of a person under the age of 15 years old, we will delete that information immediately.

7. Disclosure of Personal Information

We will not disclose, trade, rent, sell, or otherwise transfer personal information, without consent, except as otherwise set out herein or in our Terms of Use.

We may disclose your Personal Information to Support Staff for the purpose of providing, or assisting in the provision of, services to you.

We may disclose or transfer Personal Information that we collect, or that you provide, as described in this Privacy Policy to our subsidiaries and affiliates, contractors, service providers, and other third parties we use to support our business.  These third-party providers may independently collect, use, or disclose your Personal Information in accordance with their own privacy policies (and not this Privacy Policy). They may use this information to provide functionality to our Site, improve user experience, optimize our online platforms, and/or as otherwise permitted in their privacy policies.

For instance, we may provide your Personal Information to a third-party, payment processor.  We may disclose or transfer data about your search activity on our Site with Google Analytics.

We may transfer Personal Information as an asset in connection with a merger, sale, or contract agreement (including transfers made as part of insolvency or bankruptcy proceedings) involving all or part of Not 9 to 5 Organization, its Site, or its Platform, or as part of a corporate reorganization or other change in corporate control.

We may process, store, and transfer your personal information in and to a foreign country, with different privacy laws that may or may not be as comprehensive as Canadian law. In these circumstances, the governments, courts, and law enforcement, or regulatory agencies of that country may be able to obtain access to your Personal Information through the laws of the foreign country.

We may share your Personal Information to comply with applicable laws and regulations, to respond to subpoena, search warrant, or other lawful request for information we receive, or to otherwise protect our rights.  For greater certainty, we will disclose your Personal Information only to the extent that it is legally and reasonably required.

We may also disclose your Personal Information, or personal health information, in the event of an emergency pertaining to your health and/or safety. For greater certainty, we will disclose this information only to the extent that it is legally and reasonably required.

8. Data Retention

Except as otherwise permitted or required by applicable law or regulation, we will only retain your Personal Information for as long as necessary to fulfill the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements.  Under some circumstances we may anonymize your Personal Information so that it can no longer be associated with you.  We reserve the right to use such anonymous and de-identified data for any legitimate business purpose without further notice to you or your consent.

For Users that register on our Site, we also store Personal Information they provide in their user profile. All Users can see, edit, or delete their Personal Information at any time.  Site administrators can also see and edit that information, or delete it, if necessary.

9. Data Protection

We use appropriate security safeguards to protect your Personal Information against loss, theft, and unauthorized access. We utilize a comprehensive information security programme that includes written policies and procedures, as well as security controls. We have implemented reasonable administrative, technical, and physical safeguards in an effort to protect against unauthorized access, use, modification, and disclosure of personal information in our control and custody.

Our privacy practices, and this Privacy Policy, comply with applicable privacy laws including, without limitation, the Personal Health Information Protection Act (Ontario) (“PHIPA”), and the Personal Information Protection and Electronic Documents Act (Canada) (“PIPEDA”). We will maintain the privacy of your Personal Information as required by applicable laws and regulations, including, but not limited to, PHIPA and PIPEDA.

However, the safety and security of your information also depends on you. If you are a registered User of our Site, any username, password, or any other piece of information chosen by you, or provided to you as part of our security procedures, must be treated as confidential, and you must not disclose it to any other person or entity. You must exercise caution when accessing your account from a public or shared computer so that others are not able to view or record your password or other personal information. You agree to notify us immediately of any unauthorized access to, or use of, your username or password or any other breach of security. You also agree to ensure that you log out from your account at the end of each session. You are responsible for any password misuse or any unauthorized access.

If we receive a request to access or update the personal information that we have collected on behalf of a User, we will direct the party making the request to the relevant User. We will assist our Users wherever possible in responding to such access requests.

All information regarding payment is collected by a third-party service provider.  Please refer to their privacy policy for more information on how your Personal Information is safeguarded by these service providers.

10. Data Rights

It is important that the Personal Information we hold about you is accurate and current. Please keep us informed if your Personal Information changes. By law, you have the right to request access to, and correct, the Personal Information that we hold about you. If you want to access, review, verify, or correct the use of your Personal Information, you may email us at info@not9to5.org. If you are a registered User of our Site, you can also review and change your Personal Information at any time by logging into the Site and visiting your account profile page.

You can also request that we erase the Personal Information we hold about you. This does not include any data we are obliged to keep for administrative, legal, or security purposes, or any data we may keep on an anonymous basis about your use of our Site or Platform.

Where you have provided your consent to the collection, use, and transfer of your Personal Information, you may have the legal right to withdraw consent under certain circumstances. To withdraw consent, where applicable, please contact us at info@not9to5.org.

Please note that if you withdraw your consent, or request erasure of your Personal Information, we may not be able to provide you with particular content, courses, product, or services.

11. Changes to the Privacy Policy

We may update this Privacy Policy from time to time. The revised Privacy Policy will be posted on our Site. If we make substantial changes to the Privacy Policy, and the way in which we collect your Personal Information, we will post these changes on the Site, and use best efforts to notify you through our Platform via email. Please check our Privacy Policy on a regular basis.
